CONCERNS over whether Ilminster Town Council can build recreational facilities on Britten’s Field were resolved this week.
Mike Henly, who was on the town council when the 19 acres of land were bought, said he believed a requirement existed that no development should take place.
The News delved into the council’s archives this week and found the records of sale and land deeds which stated that in January 1989 Britten’s Field was bought from Somerset County Council for £47,500.
In the records, a letter from the solicitors at the time of sale said conditions were in place and that the use of the land was ‘limited to open space’.
But it added: “Just in case any buildings connected with recreational use were needed, they would still qualify under the covenant because it was use for recreation.”
A group of people opposed to the council’s plans to relocate sports pitches and provide car parking spaces, paths, plants and play equipment launched a petition to Save Britten’s Field earlier this month.
