A YOUNG driver was said to be embarrassed to find himself in the dock after he failed to provide a breath specimen at the police station.

The Upper Stratton 20-year-old, Shebhaz Dastagir, was pulled over by police in early January on his way home from a party.

A breathalyser test at the roadside found him to be over the drink-drive limit. When he arrived at the police station, he failed to provide a sample.

Dastagir later changed his mind, said prosecutor Anna Humphreys. “He made representations via a solicitor he would like to have the opportunity to have another go.

“Unfortunately, he found he had missed the chance and was charged with failing to provide a specimen of breath.” Appearing before Swindon Magistrates’ Court, Dastagir pleaded guilty.

Magistrates heard the young man, who was not working and was supported by his mother, was of previous character.

Defending, Philip Hall said: “He is a Muslim. He tells me his religion forbids the drinking of alcohol. If this case becomes public knowledge he will be greatly embarrassed.”

His client had been offered alcohol by friends: “He clearly partook enough to produce the reading at the roadside.

“He’s a young man with his life ahead of him. He and I am sure his family would be happy if he could find settled work. It’s always an advantage to have a driving licence.”

Chairman of the bench Amanda Lee said: “Your solicitor has highlighted that this was out of character, but you’re 20 years old and this can’t happen again.”

He was banned from driving for 20 months, fined £120 and £115 in costs and surcharges.
